deals with terms and conditions relating to the online sale of
products provided by Vocal Process Limited to you.
From time to
time Vocal Process Limited may advertise products for sale by
third parties and other businesses on this website. Whilst
Vocal Process Limited try to ensure that any third party
offering products for sale through this website have the same
level of service as offered by us, you will be bound by any
third party’s terms and conditions should you choose to
purchase their products. For more information see section 6
below.
Vocal Process
Limited sell products to you subject to the terms and
conditions set out on this page.
1. Terms
and Conditions
1.1 By using
this website to order a product you agree to be legally bound
with the relevant terms and condition.
1.2 By using
this website to order a product confirms that you have fully
read and agree to be bound by these terms and conditions and
to the exclusion of any customers terms and conditions.
1.3 When you
place an order to purchase a product from this website, we
will send you an email confirming receipt of your order and
containing the details of your order.
1.4 Your order
represents an offer to us to purchase a product which is
accepted by us when we send e-mail confirmation to you that we
have dispatched that product to you (the ‘Confirmation
Email’). That acceptance will be complete at the time we send
the Confirmation Email to you.
1.4.1 Any
products on the same order which we have not confirmed in a
Confirmation Email to have been dispatched do not form part of
that contract.
1.4.2 Any
places on other courses on the same order which we have not
confirmed in a Confirmation Email to have confirmed your place
do not form part of that contract.
2.
Consumer’s Right to Cancel
2.1 Customers
in the European Union are entitled to a statutory cooling-off
period of seven business days. This is where the Consumer is a
consumer within the meaning of the Consumer Protection
(Distance Selling) Regulations 2000, the Consumer may cancel
the order at any time up to the end of the seventh working day
(Monday to Friday) from the date on which the Customer
receives the Confirmation Email.
2.1.1 Vocal
Process Limited will make a full refund of any course fees
already paid provided notice is sent in writing during this

2.2 In all
other cases refunds for returns and cancellations will be as
set out in section 11 below. Also see the Returns Policy.
3. Order
Placement
3.1 Order
placement is strictly on these terms and conditions. Any order
on the Customer’s terms and conditions is only accepted by way
of convenience.
4. Pricing
and Availability
4.1 Please
note that dispatch estimates are just that. They are not
guaranteed dispatch times and should not be relied upon as
such.
4.2 As we
process your order, we will inform you by email if any
products you order turn out to be unavailable.
4.3 In the
event of a product being mispriced it is our policy that if a
product’s correct price is lower than our stated price, we
will charge the lower amount. If a product’s correct price is
higher than our stated price, we will, at our discretion,
either contact you for instructions before dispatch or cancel
your order and notify you of such cancellation.
5.
Liability
5.1 Vocal
Process Limited does not exclude or limit in any way liability
created by itself or its employees or agents for death or
personal injury, which is unlawful to exclude or limit.
5.2 Vocal
Process Limited's liability for other acts or defaults whether
by itself, its employees or, agents whether in contract, tort
(including negligence) misrepresentation (unless fraudulent)
or other legal liability is limited to:
5.2.1 For
physical loss or damage to property: the amount per claim
which Vocal Process Limited is insured for under its public
liability policy(s)
5.2.2 For all
other liability: the amount of the course fee paid.
5.3 Under no
circumstances whatsoever shall any liability accrue for:
5.3.1 Any loss
of profits or revenue, loss of goodwill or third parties
liability or
5.3.2
Consequential loss
5.4 Where the
Customer is a consumer within the meaning of the Sale of Goods
Act 1979 or the Supply of Goods and Services Act 1982 then
nothing in these conditions shall be taken as depriving him of
any rights thereunder which it is unlawful to exclude.
6. Customs
6.1 When
ordering goods from the website for delivery overseas you may
be subject to import duties and taxes, which are levied once
the package reaches the specified destination.
6.2 Any
additional charges for customs clearance must be borne by you;
we have no control over these charges and cannot predict what
they may be. Customs policies vary widely from country to
country, so you should contact your local customs office for
further information.
6.3 Please
note that when ordering from the website you are considered
the importer of record and must comply with all laws and
regulations of the country in which you are receiving the
goods.
6.4 Your
privacy is important to us and we know that you care about how
information about your order is used and shared. We would like
our international customers to be aware that cross-border
deliveries are subject to opening and inspection by customs
authorities.

7.1 By
purchasing any product from the website you acknowledge that

Process Limited is not responsible for examining or
evaluating, and we do not warrant or endorse the offerings of
any of other businesses or individuals, or the content of
their websites.
8.2 Vocal
Process Limited do not assume any responsibility or liability
for the actions, products, content and services of any of
these and any other third-parties.
8.3 You can
tell when a third-party is involved in your transactions, and
we may share customer information related to those
transactions with that third-party. It is your responsibility
to carefully review their privacy statements and other
conditions of use.
9.
Electronic Communications
9.1 When you
visit the website or send emails to us, you are communicating
with us electronically. We communicate with you by email or by
posting notices on the website. For contractual purposes, you
consent to receive communications from us electronically and
you agree that all agreements, notices, disclosures and other
communications that we provide to you electronically satisfy
any legal requirement that such communications be in writing.
This condition does not affect your statutory rights.
10. Losses
10.1 Vocal
Process Limited will be responsible for any losses you suffer
as a result of us breaching these conditions if the losses
were reasonably foreseeable to both you and us when you
commenced using the website, or a contract for the sale of
goods by us to you was formed.
10.2 Vocal Process Limited will not be
responsible for any business loss (including loss of profits,
revenue, contracts, anticipated savings, data, goodwill or
wasted expenditure) or any other indirect or consequential
loss that is not reasonably foreseeable to both you and us
when you commenced using the website or when a contract for
the sale of goods by us to you was formed.
10.3 Vocal
Process Limited does not limit in any way our liability by law
for death or personal injury caused from our negligence or
breach of duty.
11. Law and
Courts
11.1 English
Law governs the control and the English courts shall have a
non-exclusive jurisdiction.
12. Third
Party Rights
12.1 No third
party is intended to acquire rights under the Contract (Rights
of Third Parties) Act 1999.
13. Returns
and Cancellations
13.1 Please
review our Returns Policy, which
applies to products purchased from us.
13.2 In
addition to your 30-day returns guarantee, customers in the
European Union are entitled to a statutory cooling-off period
of seven business days. Details of this statutory right and an
explanation of how to exercise it are provided in the order
confirmation email and in the Returns
Policy.
14.
Interpretation
14.1 Words
denoting the singular number shall include the plural number
and vice versa and words denoting the masculine gender shall
include the feminine gender and vice versa.
14.2 Any
reference to any statute and/or regulation shall be deemed to
include a reference to all and every statutory amendment
modification re-enactment and extension in force on or after
the date of the Agreement.
15.
Alteration of Service or Amendments to the Conditions
15.1 Vocal
Process Limited reserve the right to make changes to our
website, policies, and these Terms and Conditions of Sale at
any time.
15.2 You will
be subject to the policies and Terms and Conditions of Sale in
force at the time that you use the website or that you order
goods from us, unless any change to those policies or these
conditions is required to be made by law or government
authority (in which case it will apply to orders previously
placed by you).
